Fresno D.A. Lets Accused Killers Go, Father Wants Justice

FRESNO COUNTY, Calif. (KMPH) -

New developments in the murder investigation of 30-year-old Brandon Cervantez, the father of seven shot and killed outside a Fresno bar.

Prosecutors with the Fresno County District Attorney's Office, decided not to file charges against the three men detectives arrested for the murder.

Now all three men are back on the street.

The news came as a shock to Reuben Cervantez, the father of Brandon.

Cervantez says he was told detectives and prosecutors plan to meet in the next few days to find out what additional evidence is needed to re-arrest and prosecute the men.

Reuben Cervantez says, "There are so many people that know what happened to my boy that night. These guys think they are somebody and I guess they've made others think they are somebody, so they are scared to come out and testify or talk to the police and let them know what's going on."

Cervantez does not hide the fact he was a former gang member.

He spent 17 years in prison for his mistakes.

Now out of the gang, he has this message for his son's killers.

Cervantez says, "My son he wasn't hurting no one. He didn't attack this man, but he stood over him and shot him 7 times. You're a big man with a gun but what you're not big enough and face the justice system and get what's coming to."

It was just this week, police announced the arrests of 25-year-old Daniel Rozadilla and 25-year-old Raziel Cruz, who detectives say beat Cervantez knocking him unconscious in the parking lot of a central Fresno bar on September 27, 2013.

In addition, detectives say 22-year-old Kevin Ramirez was the man who shot and killed Cervantez.

Fresno police officers are referring all phone calls to the District attorney's Office.

A spokesperson with the Fresno County D.A. office, will only say, "The investigation continues. No charges were filed pending further investigation. Rozadilla and Cruz, were cited to November first."

Meaning, there are scheduled to check with the court on that date.

Cervantez says he knows there is always street justice, but now a Christian he doesn't wish any harm on whoever killed his son.

Cervantez says, "I also forgive these guys, believe it or not I have. In my heart I have to, because how can I ask God to forgive me if I can't forgive these men."

However, he says he also believes, "If you do the crime, you must do the time."

Cervantez says he is still waiting for a response from the Fresno County District Attorney's Office.

In the meantime, he's been in touch with the governor's office asking for reward money in an effort to get people to talk.

He hopes it's just a matter of time, before he hears someone's been arrested for his son's murder.
