FRESNO, Calif. (KMPH) -
A federal judge ruled Tuesday morning that the Fresno police auditor's report can not be used as evidence in a trial after all.
The long-awaited report was released Monday following pressure from the public, media and a federal judge.
The family of Steven Vargas -- who was shot to death by a Fresno sergeant in October 2009 -- is suing the sergeant, the police chief and the city.
The family's attorney is trying to prove the police department doesn't do enough to prevent officer shootings.
However, the judge has ruled that the report has no bearing on this specific case.
